May be we can also try to reduce the retirement benefit age from 65 (or may be 67, or 70 I really don't know, whatever it is) 60. That will be tremendous help for early retirement. What do you say Mr/Mrs. Saralayar?
I am also struggling to get my GC. It is my 9th year in H1B visa. My intention is, atleast we can reduce the period for waiting to get the citizenship. It can also be considered as a good benefit for our community. Just my thoughts...

To whoever left the comment in my profile "why all this love for US Passport?"
It all depends on what country you are a citizen of. If you are a passport holder of a country like Canada,Autralia or most european countries, then you may not see much benefit in holding a US passport when travelling. But people from certain other countries, have to go through the hassle of obtaining visas prior to international travel, vacations etc. Sometimes we even have to get transit visas for countries that we pass through on our way to the final destinations. And these visas cost money. But if you hold a US passport/citizen of the US, then they do not make you jump through all those hoops. You board the plane and you get a visitors visa once you land in almost all countries (there are exceptions, India and Australia for example). But there it is. That is one of the priviledges of having a US passport.

Not only do you get SS but you also have to pay taxes to US irrespective of where you live for the rest of your life. So on a net it is still arguable depending on your long term residency plan. And my friend, Social Security is going away in the next 10 years. You think the USA can maintain this kind of a deficit for ever with people not willing to see an increase in taxes.
why dont you go back to India and stop your GC process.

I don't agree with this comment. I don't have full confidence on congress to pass full CIR bill this year. After this year, the hope will get dimmer. This proposal is better than nothing. It can propably release EB2 immediately. And move EB3 forward significantly.
Although it is not passed, we should push for anything that contains some EB relief.
02/02/2007: What Did Senator Kerry Immigration Reform Bill Mean to EB Immigrants?
In highsight, the failure of the Kerry Amendment to H.R.2 to pass the Senate could be considered a relief to the EB immigrants. Review of the immigration reform bill in the H.R. will establish that the bill proposed for the employment-based immigration system practically nothing other than increasing the annual quota to 290,000. None of the provisons in the SKIL bill was reflected in the bill, including exemption of the spouses and children from from the numerical limitations, exemption of certain EB groups from the annual numerical limits, opportunity for filing I-485/765/131 for the I-140 beneficiary during the visa number retrogression, etc. etc. etc.! Had this been enacted, it would have affected the upcoming CIR bill or special legislation for Employment-Based immigration system reform. This reporter was shocked to learn that this bill provided practically no relief for the employment-based imigrants other than farm workers and the children eligible for DREAM Act bill. The bill was extremely imbalanced legislation in a way from the perspectives of the "Comprehensive" Immigration Reform.
We will see whether the Senate leaders will indeed complete and introduce the CIR proposal next month.

Hi,
I saw response from one of the moderator.
I think that we need to point out to law makers that employment based petitioners are being differentiated from citizens . Whlie in their case the date of child is frozen on the date of the I-130 application, why not same treatment should be given for I-140.
I again hope our Core Team members will take up this issue.
This would still eliminate many of the children who have already aged out. Their dilemma was due to labor backlogs. Since labor certification is an integral stage in the employment based green card process the initial priority date should be the point at which their age is frozen. The I130 is the initial step for family based green cards, the labor cert is the initial step for employment based, NOT the I140.

I'm in a similar situation and I want to ask you if DOL withdrawn your file from the backlog center if you had a PERM application approved.
Is it Ok to have one application pending in the Backlog center and a PERM Labor certification approved if the applications are for 2 different jobs?
Thanks,
Valy

I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,
For 2nd Case should we file by mail, providing certain reason with the application?
No, I was told that you need to apply online. I just dont know how long ususaly the audit process takes.
Do you know that?

GC is moving target, looks like some drunkard wakes up one fine morning and randomly moves the priority date value/importance. I know those in such situation may be relatively less in number but I know many who are and repurcussions for this look horrible for people who have not made past this luck test. I was one of the unlucky ones :(. good luck to guys who have moved forward hope you still help rest of us still stuck.
Oh Yeah??
So why didn't we accept the current retrogression as "injustice and screwed up process of USCIS" and just sat tight? Why did IV get started? Why threadful of messages moaning in agony over the retrogression? What warranted those threads, and for that matter, IV then?

Starsun I would request you to put in another clarification for the benefit of all so that IV Core's stand is well known and published. Predictions & calculations help people to know what the ground reality is and plan their lives. Now we dont have people on IV whether EB2 or EB3 being sad after every VB because everyone knows when to expect what and predictions and calculations IMHO has gone a long way in correcting that situation.
I read several posts promoting advocacy which is very good however they take pride in trashing predictions and calculations for no apparent reason it seems to be in fashion / vogue. If advocacy has to be promoted it has to be done in a positive way there is no need to trash predictions and calculations at every available opportunity. Some of these immature comments are very disrespectful to the effort that is being put in my many of us on the predictions blog. If some people do not like what is being done on that blog they are really free not to visit but unnecessary comments should really stop or be moderated.
Teddy. The intention of such post is to tell people that they need to look beyond spending time on predictions. Predictions can help people know the extent of the backlog. For some it is a motivating factor because they were in the dark until USCIS started publishing data. People used to think their Greencard is round the corner and had no idea about the backlog. So yes the data and estimations have helped get a clearer picture. And this has benefited our community. IV has worked for several months to get the data from USCIS through its agenda item in the past. Today USCIS is publishing data at regular intervals because IV community had participated in a mass campaign to get FOIA data from USCIS. There is a whole history of advocacy behind the data everyone is using for prediction today and it was advocacy that got things done. However they should not get stuck with it and have a more 360 degree view of the issue. For some predictions are a source of encouragement for advocacy work. People leading predictions can play an important role in giving direction to others and help solve the root cause of the problem. They should be urged use it for the advocacy work as well if possible. For example a good research document can be made to illustrate visually the extent of backlogs and wait times. This document can be then circulated to media and lawmaker offices. Do not look at predictions in isolation. Secondly, the data people are using is still incomplete and has lot of assumptions. I had posted some update on the data in the donor forum early this month based on a recent meeting. So predictions we see on the forums will not be fully correct. People need to use predictions as means rather than consider it as an end.

Guys, Can we get some corporate funding on IV's effort. I agree that our contributions can also make a difference but if any big corporate decides to support our cause, don't you think it would make a very big difference, funding wise. Big companies like Mircrosoft, Oracle also do favor immigration reforms and I think they too are currently lobbying for the same. If somehow, we can also extract some contributions from them for the same cause that would really give great impetus to IV's efforts.

I booked my ticket a month ago but haven't yet figured out accommodation and travel within DC. I'm flying into DC on Sunday, 3rd morning.
Is someone looking to share a hotel room? Alternately, is any DC area member still looking to offer a spare sleeping bag? :)
I don't know how the DC area works but would preferably like to stay closer to the event hotel. If not, I'm open to renting a car and sharing cost to get in/out of DC (heard the traffic is a nightmare though).
Please PM me directly or reply here. I'm joining the conference call tonight as well.

Says who?
How do you know that US masters degree dont need to work for consulting firms?
Do US masters degree holders work for Deloitte? IBM Global Services? Accenture? KPMG? Price Water House Coopers?
What about Oracle consulting services? What about TRW? Bearingpoint?
All these are consulting companies or the divisions of consulting companies. Both US degree holders and the non-US degree holding duffers like myself work in consulting firms(I dont anymore since 2003). In fact, I have had my classmates from India have to look for consulting jobs after they did MS in computer science from USA.
You are under the impression that the bill is outlawing desi consulting firms and firms that exploit.
The bill outlaws OUTPLACEMENT. And the bill applies to all firms, desi firms and the big 5 consulting firms and your IBM, TRW ... everyone.
Please read the bill and read the description in the first post.
And although I am the last one to engage in US-degree versus non-US degree and Masters Versus Non-Masters fueds, I am tempted to say that US masters or US degree isnt worth a bucket of warm spit when the market is bad.
When the market is really bad, like it was in 2001 and 2002, I have seen many Masters degree holders pack up and throw in the towel and I have seen many individuals with degrees from private Tier 3 university from India survive just fine in an environment where there were 80 resumes for each IT job. The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT.
However if you are proud of your US degree and US masters, suit yourself. But dont say things like "I dont need consulting". Coz you really do and so do thousands of others having US degrees.
I take strong exception to following statements:
"The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT. "
The above statement is completely wrong. I needed assembly level programming and the binary math for designing satellite switched routers. There is no way to get packet processing time to less than a micro second without knowing assembly language and binary math. I have been in R&D for 3.5 years and I can assure all of you who are taking these courses that these courses are very relevant if you are looking for a job in high computing and high performance industry.
In addition I passed MS in 2001 and alongwith many others went through the same period of 2001 job market!
